Welcome to Trackwize.

These Terms of Service explain the rules for using our website, joining our waitlist, and using any Trackwize products or services.

We have written them in plain English because we believe legal documents should be understandable.

Acceptance of these Terms

By accessing our website, joining our waitlist, creating an account, or using any Trackwize service, you agree to these Terms of Service.

If you do not agree with these Terms, please do not use our website or services.

These Terms are governed by the laws of India. Subject to applicable law, the courts located in Pune, Maharashtra shall have exclusive jurisdiction over disputes relating to these Terms.

Trackwize is a work intelligence platform for service teams based in Pune, Maharashtra, India.

Eligibility

You must be at least 18 years old and legally capable of entering into a binding agreement to use Trackwize.

If you use Trackwize on behalf of an organisation, you confirm that you have authority to accept these Terms on behalf of that organisation.

Using Trackwize

You agree to use Trackwize only for lawful purposes. You must not:

• →Probe or test the security of our services without written permission
• →Reverse engineer or interfere with the operation of the service except where permitted by law
• →Upload malicious software or harmful content
• →Use Trackwize to violate the rights of others
• →Impersonate another person or organisation
• →Use automated tools to scrape or harvest our website without written permission
• →Attempt to interfere with other users or our infrastructure

We may suspend or terminate access if these Terms are violated.

Accounts

You are responsible for maintaining the security of your account credentials.

You are responsible for activities that occur under your account unless caused by our failure to protect our systems.

Please notify us promptly if you believe your account has been compromised.

Waitlist and beta access

Joining our waitlist does not guarantee access to our beta or future products. Beta invitations are provided at our discretion based on factors including product fit and available capacity.

Beta software is provided for testing and evaluation purposes. It may contain bugs, incomplete features, or unexpected behaviour. You should not rely on beta software for critical business operations unless we have expressly agreed otherwise in writing.

We may modify, suspend, or discontinue beta access at any time.

AI-powered features

Some Trackwize features use artificial intelligence provided by trusted third-party providers.

By choosing to use these features, you authorise Trackwize to transmit the content you submit — including screenshots, documents, product specifications, or text — to our AI service providers solely for the purpose of generating the requested results.

You are responsible for ensuring that you have the necessary rights and permissions to submit any content for AI processing.

Customer content

You retain ownership of the content you submit to Trackwize.

You grant Trackwize a limited licence to process, store, transmit, and analyse your content solely for providing, maintaining, securing, and improving the services.

We do not acquire ownership of your content.

Intellectual property

Trackwize — including our software, website, branding, logos, designs, documentation, and other content — is owned by Trackwize or its licensors and is protected by applicable intellectual property laws.

You may not copy, modify, distribute, sell, license, or create derivative works from our materials without prior written permission except where permitted by law. Reasonable quotations with proper attribution are permitted.

Privacy

Our collection and use of personal information is described in our Privacy Policy. By using Trackwize, you acknowledge that your information will be handled as described in that policy.

Service availability

We work hard to keep Trackwize available and reliable. However, we do not guarantee uninterrupted availability or that every feature will always operate without errors. We may perform maintenance, updates, or improvements that temporarily affect availability.

Third-party services

Trackwize relies on third-party service providers to operate certain features, including cloud infrastructure, email delivery, and AI processing. We are not responsible for interruptions or failures caused by those third-party services.

Disclaimer of warranties

To the maximum extent permitted by applicable law, Trackwize is provided on an “as is” and “as available” basis.

We do not guarantee that the service will be uninterrupted, error-free, secure against every possible threat, or suitable for every purpose. You use the service at your own risk.

Nothing in these Terms excludes warranties that cannot legally be excluded.

Limitation of liability

To the fullest extent permitted by applicable law, Trackwize, its founders, employees, and affiliates will not be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages arising from or relating to your use of the website or services.

Our total liability for any claim arising from these Terms will not exceed the amount you paid to Trackwize during the twelve months immediately preceding the event giving rise to the claim.

If you are using a free beta version of Trackwize, our maximum liability will be limited to the extent permitted by law.

Nothing in these Terms limits liability where such limitation is prohibited by applicable law.

Indemnity

You agree to indemnify and hold harmless Trackwize from claims, losses, damages, liabilities, and reasonable legal expenses arising from your unlawful use of the service or your violation of these Terms.

Suspension and termination

We may suspend or terminate your access if:

You may stop using Trackwize at any time. Termination does not affect rights or obligations that arose before termination.

Changes to these Terms

Your continued use of Trackwize after the updated Terms become effective means you accept the revised Terms. The date at the top of this page reflects the latest version.

Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue to apply.

Entire agreement

These Terms, together with our Privacy Policy and any additional written agreements between you and Trackwize, constitute the entire agreement relating to your use of the service.
